Pine Rivers Special Hardship Licence Lawyer

The Brisbane Drink Driving Lawyer team achieved an excellent outcome at Pine Rivers Magistrates Court recently.

Our client received a 6 month Queensland Transport driver's licence suspension as a result of having breached what is known as a Good Driving Behaviour Period.

When a person accumulates too many demerit points, Queensland Transport will send that person a letter asking them to choose between a 3 month driver's licence suspension, and a 12 month Good Driving Behaviour Period.

If you do nothing, you will automatically be allocated the 3 month driver's licence suspension.

If you elect the Good Driving Behaviour Period by the election cut off date, you will be granted 2 bonus demerit points.

If you can last 12 months without losing those 2 demerit points, that will be the end of the matter and your licence will be fully reinstated.

If you lose those 2 demerit points, you will receive a 6 month (sometimes longer depending upon your traffic history) driver's licence suspension.

If you have not lost your licence for any other reason within the last 5 years, and you satisfy certain other prerequisite criteria, you will be eligible to apply for what is known as a Special Hardship Licence.

Simple eligibility, however, does not equate to automatic success.

A Special Hardship Licence essentially overlaps the 6 month driver's licence suspension and permits you to continue driving for works and/or medical purposes only.

That is the situation our client found themselves in, and we were engaged to apply for a Special Hardship Licence on their behalf.

We drafted all of the relevant Affidavit materials on our client's and their employer's behalf.

The documents were filed at Pine Rivers Magistrates Court a few weeks prior to the court date, copies of which were served upon Queensland Transport.

We argued the application at Pine Rivers Magistrates Court recently.

We were successful in persuading the Magistrate to grant our client's Special Hardship Licence application.

Instead of being unable to drive throughout the next 6 months, our client can now continue to drive for work purposes during the driver's licence suspension for work purposes only, 24 hours per day 7 days per week.
